Unfair Bank Charges – You can still claim them back!
If you have suffered excessive bank charges through missing payment deadlines, bouncing cheques, exceeding your overdraft limit etc, then the good news is that it is still possible to claim bank charges back if you have a valid reason for doing so.
The banks won an appeal through the Supreme Court in November that allowed them to continue to penalize people heavily for breaking the terms and conditions of their personal and business banking accounts. However it is still possible to complain about unfair bank charges in certain circumstances.
The first reason for making a complaint to recover unfair bank charges is if you are suffering financial hardship. If you can't pay for necessities such as mortgage or rent payments, council tax, food or utility bills then this would fit into the ‘financial hardship' category. Also if you are struggling to pay debts, if you've had a substantial drop in income, if your income is being eaten by unfair bank charges, if you have to spend more due to a disability or illness, if you are going bankrupt or onto a debt management plan then all of these circumstances would qualify as ‘financial hardship' and would enable you to claim bank charges back.
The second reason to reclaim unfair bank charges is because the charges may have been ‘disproportionate.' Unfortunately, there is no ‘black and white' argument for making a complaint due to being charged disproportionately, but an example of this would be if you had gone a couple of pounds overdrawn and the bank were to charge £40 or so. You could attempt to claim bank charges back as you could reasonably argue that the charge was excessive.
The third reason to complain about unfair bank charges would be because of a ‘snowball effect' which means that you have been charged upon charge. For example, if you were close to your overdraft limit and you wrote a cheque that ‘bounced' you would be charged for bouncing the cheque. The charge could then mean you breach your overdraft limit and therefore you are charged again! If this applies to you then you would have a good case to claim bank charges back in these circumstances.
